Nothing in these Terms and Conditions limits or removes your statutory rights under applicable UK law.

Course Bookings and Confirmation
Customers may enquire about training by telephone, email, text message, website enquiry form or another communication method accepted by the Company.
- All bookings are subject to availability, course suitability and confirmation.
- An enquiry or provisional reservation does not guarantee a training place.
- A booking is confirmed once accepted by the Company and any required deposit or payment has been received.
- Customers must provide accurate Candidate details, course requirements and relevant experience information.
- Customers should check their Booking Confirmation and report incorrect information promptly.
- Any required deposit and payment deadline will be communicated before booking confirmation.
- Provisional reservations may be released if payment is not received by the agreed deadline.
- Bookings made close to the Course Date may require immediate payment.
Course-specific prerequisites, assessment requirements and additional conditions communicated before confirmation form part of the booking agreement.
Course Fees, Deposits and Payments
Course Fees will be confirmed before a Customer commits to a booking. Where VAT applies, the applicable amount will be clearly communicated. Prices provided to individual consumers will include applicable taxes and compulsory charges in the total payable.
- A deposit or full payment may be required to secure a place.
- Unless otherwise agreed in writing, outstanding Course Fees must be paid before training begins.
- Where credit terms are expressly agreed with a business Customer, undisputed invoices must be paid within seven Calendar Days of receipt unless another deadline is agreed.
- Training may be postponed or declined where agreed payments remain outstanding, subject to applicable consumer rights.
- Additional training, reassessment or services outside the original booking will be quoted separately.
- Where legally permitted and consistent with certification requirements, certificates may be withheld until agreed payments are completed.
Customers should contact us promptly if they have questions about an invoice, payment or outstanding balance.
Our Responsibilities
Power Forklift Training Ltd is committed to providing professional, safety-focused training services with reasonable care, skill and diligence.
We will:
- Use suitably competent instructors and follow relevant training requirements and safety standards.
- Provide appropriate instruction, practical exercises and assessments for the booked course.
- Make reasonable efforts to deliver training on the agreed dates and at the agreed location.
- Communicate significant changes to confirmed arrangements as soon as reasonably practicable.
- Provide appropriate safety instructions before and during practical training.
- Make reasonable adjustments where required by applicable law, taking account of safety and certification requirements.
- Explain relevant course completion and certification arrangements.
Training end times may vary depending on course requirements, Candidate experience, practical progress and assessment needs. Any significant change to the agreed service will be discussed with the Customer.
Customer and Candidate Responsibilities
Customers and Candidates must cooperate with the Company to ensure training is delivered safely and effectively.
Candidates are expected to:
- Attend on the confirmed Course Date and arrive at the agreed time.
- Meet the course prerequisites, eligibility requirements and experience level communicated before booking.
- Provide accurate personal information required for training records and certification.
- Follow reasonable instructions from instructors and authorised personnel.
- Wear appropriate clothing and required personal protective equipment.
- Comply with health and safety procedures and site rules.
- Operate equipment only with instructor permission and within supervised training activities.
- Treat instructors, staff, other Candidates and equipment respectfully.
- Inform us of relevant support or reasonable adjustment requirements before training where practicable.
Where a business books training for employees, that business remains responsible for selecting Candidates suitable for the course.
The Company may suspend an activity where a Candidate is inadequately prepared or continuing would present an unacceptable safety risk.
Language and Communication Requirements
Candidates must understand essential safety instructions, warnings and assessment requirements associated with their course.
Training is generally available in English. Multilingual instruction or additional language support may be arranged where an appropriately qualified instructor is available.
- Requests for instruction or support in another language should be made before booking.
- A particular language is not guaranteed unless confirmed in advance.
- Some certification schemes have specific language or assessment requirements.
- Interpreters require prior approval and must be permitted under the relevant course and assessment rules.
Where essential safety instructions cannot be understood and suitable arrangements are unavailable, training may be postponed or discontinued.
Any resulting charges or refunds will be considered fairly under these Terms and applicable law.
Cancellations, Refunds and Non-Attendance
We understand that plans sometimes change. Customers should notify us as early as possible when requesting a cancellation, substitution or change of Course Date.
8.1 How to Cancel
Cancellations may initially be requested by telephone but should also be confirmed in writing by email or another agreed written communication method. A cancellation takes effect when we receive clear notice of the decision to cancel.
8.2 Cancellation Charges
Subject to applicable statutory rights and consumer protection law, the following cancellation arrangements apply to confirmed bookings.
| Notice Given | Cancellation Arrangement |
|---|---|
| 14 or more Calendar Days | Refund less a £50 administration charge. |
| 8–13 Calendar Days | Refund less a £50 administration charge. |
| 7 or fewer Calendar Days | Up to the full Course Fee, limited to reasonable losses. |
| Failure to Attend | Normally treated as a late cancellation, subject to applicable rights. |
Cancellation charges must fairly reflect the Company's reasonable losses caused by cancellation. We will take reasonable steps to reduce those losses, including considering avoided costs and whether the place can be filled.
Charges will not exceed the Course Fee. No charge will be imposed where doing so would conflict with a Customer's statutory rights.
8.3 Candidate Substitutions
Customers may request a replacement Candidate without an administration charge before training begins, provided the substitute meets the course requirements, the change is permitted under relevant certification rules and no materially different service is required.
8.4 Rescheduling Requests
Requests to change a Course Date will be considered according to availability, notice given and commitments already incurred. Any applicable rescheduling charge will be explained and agreed before confirmation.
8.5 Refund Processing
Where a refund is due, it will be processed within the timeframe required by law or, where no specific timeframe applies, within a reasonable period. Refunds will normally use the original payment method unless otherwise agreed.
Consumer Cancellation Rights
This section applies to individual consumers where statutory cancellation rights are available.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, an eligible distance or off-premises service contract generally provides a cancellation period of 14 days after the day the contract is entered into.
This statutory right is separate from the course cancellation arrangements described in Section 8.
- Eligible consumers may cancel within the statutory period without giving a reason.
- Consumers may expressly request that training begins during this period, subject to legal requirements.
- If a valid cancellation occurs after requested services have begun, a proportionate charge may apply where permitted by law and the required information and consent procedures were followed.
- The cancellation right may end following full performance of the service where all relevant legal conditions have been met.
Where required by law, we will provide relevant cancellation information or a cancellation form before the contract is entered into.
Your statutory rights: Nothing in these Terms and Conditions excludes or restricts mandatory consumer cancellation, refund or other legal rights.
Changes or Cancellations by the Company
We may occasionally need to change a Course Date, instructor, Training Location or another arrangement because of operational, safety or exceptional circumstances.
- We will communicate material changes as soon as reasonably practicable.
- Where the agreed training cannot be provided, we will normally offer an appropriate alternative arrangement or date.
- If the alternative is unacceptable and we cannot fulfil the booking, an appropriate refund will be provided for services not delivered, subject to applicable law.
- Training may be cancelled, suspended or postponed where significant safety risks prevent its delivery.
- Where a Customer's failure to meet agreed requirements causes cancellation, reasonable attributable losses may be charged where permitted by law.
A minor change that does not materially affect the agreed services will not automatically constitute cancellation.
Training Assessments and Certification
Some courses include written or theoretical tests, practical assessments and other competency checks. Candidates must satisfy the applicable requirements to achieve successful course completion or certification.
- Payment for training does not guarantee a pass, qualification or certificate.
- Relevant courses may be associated with RTITB, NPORS, IPAF or ALLMI certification schemes.
- The certificate, card or training record provided depends on the booked course and its requirements.
- Additional training or reassessment may be recommended when a Candidate does not meet the required standard.
- Any additional reassessment or training charges will be explained before agreement.
- External certification and registration procedures may affect processing times.
We aim to arrange the issue or dispatch of eligible certificates within 30 days of successful course completion, subject to the relevant scheme's procedures and payment requirements. This is an estimated timeframe, not a guarantee.
An operator certificate or card records training or assessment under the relevant scheme. It does not guarantee employment or replace an employer's responsibility for site-specific familiarisation, further training or operating authorisation.
Candidate Conduct and Safety
Every Candidate must behave responsibly throughout their training and follow applicable safety instructions.
Harassment, threats, deliberate disruption, unsafe equipment operation or behaviour that places others at risk will not be tolerated.
Candidates must not participate while impaired by alcohol, illegal drugs or another substance that prevents safe participation.
Instructors may stop unsafe activities immediately. Where reasonable and safe, Candidates may be given an opportunity to correct inappropriate behaviour.
We may remove a Candidate from a course where serious misconduct or safety risks justify doing so. Any fees retained will be assessed fairly, taking account of the circumstances, services provided, reasonable losses and applicable law.
Candidates and Customers retain the right to raise complaints and exercise their legal rights.
On-Site Training at Customer Premises
Training may be delivered at a Customer's premises, subject to appropriate arrangements and suitable working conditions.
For on-site training, the Customer must:
- Provide a suitable, safe and accessible training environment.
- Ensure that machinery and equipment supplied for training are safe, properly maintained and suitable for use.
- Make required equipment inspection, examination and maintenance records available where applicable.
- Provide sufficient space, suitable ground conditions and appropriate pedestrian and traffic controls.
- Arrange any required site inductions, permissions and emergency procedures.
- Provide agreed site-specific PPE and facilities.
- Disclose relevant site hazards or restrictions before training.
- Cooperate with instructor instructions and reasonable safety requirements.
We may suspend, abandon or rearrange training where the location, equipment or working conditions are unsuitable or unsafe.
Where training cannot proceed because the Customer failed to meet agreed requirements, the Customer may be responsible for reasonable, evidenced costs directly resulting from that failure, subject to applicable law.
We will explain the reason for any suspension or rearrangement and discuss suitable next steps.
Intellectual Property and Training Materials
Training documents, diagrams, presentations, illustrations and other resources supplied by Power Forklift Training Ltd may be protected by copyright and other intellectual property rights.
Unless otherwise agreed, rights in materials owned or created by the Company remain with the Company or the relevant rights holder.
Customers and Candidates may use supplied materials for their own learning, reference and authorised internal training purposes.
Materials must not be commercially reproduced, republished, distributed or used to provide competing training services without the relevant permission. Copyright notices must not be removed or altered without authorisation.
Nothing in this section restricts rights that cannot lawfully be excluded.
Confidentiality and Data Protection
We respect the confidentiality of relevant customer and business information. Confidential information will be handled appropriately and will not be disclosed without authorisation unless disclosure is required or permitted by law.
We process personal information for purposes that may include managing enquiries, bookings, training, assessments, certification, payments and related legal obligations.
Personal information is handled in accordance with applicable UK data protection legislation, including the UK GDPR and the Data Protection Act 2018, as amended.
Information may be shared with relevant certification bodies, payment service providers or other necessary service providers where lawful and appropriate. We take suitable measures to protect personal information.
Customers arranging training for other individuals must provide relevant information lawfully and communicate appropriate privacy information to Candidates where required.
For details about personal data, retention, data-sharing arrangements and your privacy rights, please read our Privacy Policy.
Limitation of Liability
Power Forklift Training Ltd will exercise reasonable care and skill when delivering agreed training and associated services.
Nothing in these Terms and Conditions excludes or restricts liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Obligations that cannot lawfully be excluded or limited.
- Other liabilities that applicable law does not permit us to restrict.
For consumer Customers, we remain responsible for foreseeable loss or damage resulting from a breach of contract or failure to exercise reasonable care and skill, subject to applicable law.
We do not guarantee employment, universal employer acceptance of a particular qualification or a specific assessment outcome.
For business Customers acting in the course of business, and only to the extent permitted by law and reasonable in the circumstances, our total liability arising from a particular training booking will be limited to the total fees paid or payable for the affected services, excluding liability that cannot lawfully be limited.
Business Customers remain responsible for their workplace operations, employees, equipment and site-specific operating authorisations. Nothing in this section affects rights and remedies available under applicable law.
Events Beyond Reasonable Control
Neither party will be responsible for a delay or failure to perform contractual obligations to the extent directly caused by circumstances beyond that party's reasonable control, provided reasonable steps are taken to minimise the effects.
Examples may include:
- Severe weather, flooding, fire or natural disasters.
- Government restrictions or emergency measures.
- Serious disruption to essential infrastructure.
- Major transport disruption.
- Industrial action outside the affected party's reasonable control.
- Other exceptional events preventing safe or lawful delivery of services.
The affected party must notify the other as soon as reasonably practicable, and both parties will attempt to agree appropriate alternative arrangements.
Where a booking cannot be fulfilled and is brought to an end, payments for services not delivered will be handled in accordance with applicable law and relevant contractual rights.
Complaints and Dispute Resolution
We aim to provide professional training and customer service. If you have concerns about a booking, instructor, assessment, payment or training experience, please contact us.
Where possible, include your name, course details, relevant dates and a description of your concern.
We will review complaints fairly and respond within a reasonable period. Where a concern relates to an external awarding or certification body, its relevant procedures may also apply.
We will make reasonable efforts to resolve disputes through direct communication. Nothing in this section prevents Customers from obtaining independent advice, pursuing statutory remedies or taking appropriate legal action.
Changes to These Terms and Conditions
We may update these Terms and Conditions to reflect operational, regulatory or legal changes.
The version applicable to a booking will normally be the version made available when the booking agreement was entered into.
Changes made after confirmation will not materially alter an existing agreement unless both parties agree or the change is required by law.
Updated Terms and Conditions may be published on our website, with the relevant last-updated date.
General Provisions
- If any provision is found to be invalid or unenforceable, the remaining provisions continue to apply where permitted by law.
- Failure to enforce a provision immediately does not automatically waive a party's rights.
- We may use suitably qualified instructors, subcontractors or service providers while remaining responsible for our contractual obligations.
- These Terms, the Booking Confirmation and any expressly agreed additional conditions form the agreement between the Company and Customer.
- Agreed changes to confirmed bookings should be recorded in writing.
- No third party has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999, except where expressly provided or required by law.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer protection law permits proceedings in another competent court or provides other mandatory protections.
